Terms of Service

1. Agreement to Terms

By downloading, installing, accessing, or using the AI H5P Activity Generator desktop software ("Software"), you agree to be bound by these Terms of Service ("Terms"). The Software is provided by EduLab. If you do not agree to these Terms, you must not use the Software.

2. License and Permitted Use

Free Use: The Software may be freely downloaded, installed, and used without payment.

Credits for Generations: Certain features, including generating H5P files, require purchasing credits. Credits are sold separately and are consumed when used.

License Grant: EduLab grants you a limited, non-exclusive, non-transferable, revocable license to use the Software for generating H5P educational activities, subject to these Terms.

Distribution: You may copy and share the unmodified installer of the Software for free distribution.

Restrictions: You may not:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code.
• Modify, alter, or create derivative works of the Software.
• Sell, rent, lease, or commercially redistribute the Software or modified versions of it.
• Use the Software for any illegal or unauthorized purpose.
• Generate or distribute content that is unlawful, abusive, defamatory, obscene, or otherwise objectionable.

3. Payments and Credits

Payment Processor: Purchases of credits are handled by Paddle.com Ltd., our authorized reseller. By purchasing credits, you also agree to Paddle's Terms of Use and Privacy Policy.

Non-Refundable Purchases: Due to the digital nature of credits and their immediate availability upon purchase, all sales are final. Refunds are only issued at EduLab's sole discretion in exceptional cases.

Expiration of Credits: Credits do not expire unless otherwise specified at the time of purchase.

4. Intellectual Property

Software Ownership: The Software, its design, and all related intellectual property are the exclusive property of EduLab and its licensors.

User Inputs: You retain ownership of the text prompts or other data you provide ("Inputs").

Generated Outputs: Subject to compliance with these Terms, you own the H5P files and educational content generated for you by the Software ("Outputs"). However, you acknowledge that similar or identical Outputs may be generated for other users due to the nature of AI.

5. Third-Party Services

The Software integrates with third-party services:

Google Gemini API: Inputs are sent to Google's AI models to generate Outputs. Use of the API is subject to Google's terms and AI principles.

Paddle.com: All payments and licensing are managed by Paddle under their own policies.

6. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your data. By using the Software, you consent to our data practices as described therein.

7. Disclaimer of Warranties

The Software is provided "as is" and "as available" without warranties of any kind, express or implied. EduLab does not guarantee that the Software will be error-free, secure, or uninterrupted. You are solely responsible for verifying the accuracy and appropriateness of all generated Outputs.

8. Limitation of Liability

To the maximum extent permitted by law, EduLab and its owner, Attallah Mouafki, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from:

• Your use of or inability to use the Software;
• Replacement costs for goods or services;
• Third-party services integrated into the Software (e.g., Google, Paddle).

9. Indemnification

You agree to indemnify and hold harmless EduLab and its owner from any claims, damages, liabilities, or expenses (including legal fees) arising from your misuse of the Software, your violation of these Terms, or your infringement of any third-party rights.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of your local jurisdiction, without regard to conflict of law principles.

11. Changes to Terms

EduLab reserves the right to update or modify these Terms at any time. Updates will be posted with a revised "Last Updated" date. Continued use of the Software after changes constitutes acceptance of the new Terms.
